By creating an account or otherwise using Phoenix, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. Phoenix is not intended for use by anyone under 18, and we do not knowingly permit minors to use the App.
Phoenix provides AI-assisted wellness and informational features that allow you to log and reflect on health-related information and receive AI-generated responses. Features and functionality may change, be added, or be removed at any time without prior notice.
Phoenix is not a medical service and does not replace professional medical advice, diagnosis, or treatment. The App does not provide medical care, and its AI-generated content is for general informational and wellness purposes only.
Always seek the advice of a qualified physician or other health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or received through the App. If you believe you may have a medical emergency, call your local emergency number immediately.
If you express thoughts of self-harm or indicate you may be in emotional crisis while using the App, our AI-powered features are designed to respond supportively and encourage you to reach out to a trusted person, and may display general safety information and crisis-support resources appropriate to your app's language setting. Phoenix is not a crisis intervention service, does not monitor conversations in real time for the purpose of dispatching emergency assistance, and cannot contact emergency services or any other party on your behalf. If you or someone else is in immediate danger, contact your local emergency services directly.
Phoenix and its operators are not liable for any decisions made or actions taken based on content provided by the App.
Phoenix uses third-party artificial intelligence providers (currently AvalAI and Groq, with a self-hosted Ollama instance as a fallback if neither is available) to generate responses to your inputs. AI-generated content:

If the App requires registration, you agree to provide accurate information (such as a valid email address) and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

If the App offers paid subscriptions or in-app purchases, they are processed through RevenueCat and billed via the Apple App Store, Google Play, or our website, depending on where you obtained the App. Purchases are subject to the payment terms, refund policies, and auto-renewal rules of the platform through which you subscribed. We do not directly process or store your payment card information.
The App, including its design, text, graphics, logos, and underlying technology, is owned by Phoenix Recovery (Independent Developer) or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.
The App relies on third-party providers (including AI/LLM providers, analytics and crash-reporting services, and subscription/payment processors) to operate. Your use of the App is also subject to the applicable terms and privacy policies of those providers, as described in our Privacy Policy. Phoenix does not currently use advertising partners.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Phoenix Recovery (Independent Developer) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR PROFITS, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App and request account deletion at any time.
We may modify these Terms from time to time. Material changes will be indicated by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
These Terms shall be governed by the laws of Australia, without regard to its conflict of law principles, except where local consumer protection laws (such as the Australian Consumer Law) or other mandatory laws of your country of residence require otherwise.
